These Terms of Service ("Terms") govern your use of the Facilo SaaS portal ("Service"), operated by Facilo, Berlin, Germany. By accessing or using the Service, you agree to be bound by these Terms.
2. Service Description
Facilo provides a facility management and fleet service platform including:
- Job scheduling and workforce management
- Customer and property management
- Invoice generation and payment tracking
- Calendar and scheduling tools
- API access for enterprise customers
3. User Accounts
- You must provide accurate and complete registration information
- You are responsible for maintaining the confidentiality of your credentials
- You must notify us immediately of any unauthorized account use
- We reserve the right to suspend or terminate accounts that violate these Terms
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Upload malicious code or attempt to compromise the Service's security
- Exceed rate limits or abuse API access
- Resell or redistribute the Service without authorization
- Impersonate others or provide false information
5. Subscription & Payment
- Free tier includes basic features with usage limits
- Paid plans are billed monthly or annually via Stripe
- All fees are non-refundable unless required by law
- We reserve the right to change pricing with 30 days' notice
- Failed payments may result in service suspension
6. Intellectual Property
- The Service, including its code, design, and branding, is owned by Facilo
- You retain ownership of your data (customer records, jobs, invoices)
- You grant us a limited license to process your data to provide the Service
7. Data Protection
We process personal data in accordance with our Privacy Policy and applicable data protection laws (GDPR). By using the Service, you confirm that you have the necessary consents to provide any third-party personal data you enter.
8. Limitation of Liability
- The Service is provided "as is" without warranties of any kind
- We are not liable for indirect, incidental, or consequential damages
- Our total liability is limited to the fees you paid in the 12 months preceding the claim
- We are not liable for service interruptions beyond our reasonable control
9. Termination
- You may terminate your account at any time through Settings
- We may terminate accounts with 30 days' notice for any reason
- Immediate termination is possible for Terms violations or non-payment
- Upon termination, your data will be deleted in accordance with our retention policy
10. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email or in-app notification. Continued use of the Service after changes constitutes acceptance.
11. Governing Law
These Terms are governed by the laws of the Federal Republic of Germany. The place of jurisdiction is Berlin.
